Boost Terms of Service

This website is owned and controlled by Boost (“we,” “our,” or “us”). By accessing or using our website, products and services (collectively, the “Services”), you agree to comply with and be bound by the following Terms of Service (the “Terms”). If you do not agree to these Terms, you may not use our Services.

1. Acceptance of Terms

By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, Cookie Policy, and any other policies referenced herein. 

2. Eligibility

To use our Services, you must be at least 18 years of age and legally capable of entering into a binding contract. If you are using the Services on behalf of an organization, you represent that you are authorized to bind the organization to this Agreement.

3. Healthcare Data and HIPAA Compliance

The Services may involve the collection, storage, and processing of health-related data, including Protected Health Information (PHI). As such, we comply with HIPAA (Health Insurance Portability and Accountability Act) to ensure the confidentiality, integrity, and security of health data. By using our Services, you agree to comply with all applicable HIPAA provisions.
 

  • Covered Entities and Business Associates
    If you are a healthcare provider or business associate, you are responsible for ensuring that you have the necessary HIPAA-compliant agreements (Business Associate Agreement or BAA) in place with us.

 

  • Data Security and Privacy
    We implement robust security measures to protect PHI. However, you are responsible for ensuring that the data you input into the system is accurate and that you take appropriate measures to safeguard your login credentials.

4. California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA)

If you are a resident of California, you have rights under the **California Consumer Privacy Act (CCPA)** and **California Privacy Rights Act (CPRA)** regarding your personal data. These include:

  • Right to Access
    You have the right to request access to the personal information we have collected about you, including the categories of information, purposes for collection, and third parties with whom we share your data.
     

  • Right to Deletion
    You can request the deletion of your personal data, subject to certain exceptions.
     

  • Right to Opt-Out
    You have the right to opt-out of the sale of your personal data (if applicable). Boost does not sell personal data.
     

  • Right to Correct
    You have the right to request the correction of inaccurate personal data.
     

  • Right to Non-Discrimination
    We will not discriminate against you for exercising any of your rights.

5. Data Collection and Use

By using our Services, you consent to the collection, use, and sharing of your personal data as outlined in our Privacy Policy. We collect information such as:

  • Personal Data
    Name, email, phone number, billing information, etc.
     

  • Health Data
    Patient information, treatment details, prescriptions, etc., which we collect in compliance with HIPAA and applicable state laws, including **California Confidentiality of Medical Information Act (CMIA)**.
     

  • Technical Data
    Usage patterns, device information, and logs to improve the performance and user experience of the Services.

We only collect data that is necessary to provide the Services and comply with applicable legal requirements.

6. User Responsibilities

As a user of our Services, you agree to:

  • Provide accurate and complete information to the best of your ability.

  • Use the Services only for lawful purposes and in compliance with applicable laws, including healthcare privacy laws such as HIPAA and CMIA.

  • Maintain the confidentiality of your account credentials and notify us immediately if you suspect any unauthorized access or use of your account.

  • Refrain from uploading or transmitting any data that violates applicable laws, including sensitive data that is not authorized for disclosure under HIPAA or CMIA.

7. Prohibited Uses

You may not use the Services for any of the following:

  • Violating any applicable federal, state, or local laws, including HIPAA, CCPA/CPRA, and CMIA.

  • Distributing or transmitting any unlawful, harmful, or offensive content.

  • Using the Services to transmit or store malicious software or viruses.

  • Interfering with the proper functioning of the Services, including accessing or using the platform in an unauthorized manner.

8. User-Generated Content

You are responsible for all data and content you upload, submit, or otherwise transmit through the Services. By submitting content, you represent that you have all necessary rights and permissions to use and share such content, including complying with HIPAA and other applicable laws regarding patient information.


We are not liable for any violation of applicable laws arising from content you submit to the platform.

9. Termination

We may suspend or terminate your access to the Services if we believe you have violated these Terms or if required by law. You may terminate your account at any time by contacting us at missionsupport@boostresults.com.

Upon termination, all rights to use the Services will cease, and we will delete your data as required by applicable laws.

10. Intellectual Property

All content, software, trademarks, and other intellectual property used or displayed in the Services are owned by Boost or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for its intended purpose, subject to these Terms.


You agree not to copy, modify, reverse-engineer, distribute, or otherwise exploit any part of the Services without our prior written consent.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Boost will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. This includes, but is not limited to, loss of data, business interruption, or unauthorized access to your information.


We do not guarantee that the Services will be error-free or uninterrupted, but we will take reasonable steps to maintain the availability and reliability of the platform.

12. Indemnification

You agree to indemnify and hold harmless Boost, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Services, violation of these Terms of Service, or infringement of third-party rights.

13. Changes to the Terms

We may modify or update these Terms from time to time. When we make significant changes, we will notify you through the Services or post on our website. We encourage you to review these Terms periodically for updates. Your continued use of the Services after any such modifications constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in San Francisco, California.
